Filing a notice
A valid DMCA notification must be sent to our designated agent (see below) and must include all of the following:
- A physical or electronic signature of the copyright owner (or a person authorized to act on the owner's behalf).
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the allegedly infringing material with enough detail to allow us to locate it (URL or listing ID is best).
- Your contact information — address, phone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Designated agent
DMCA notifications and counter-notifications should be sent to our designated contact for copyright notices:
- Email: support@wheelhouse.mobile — please include “DMCA” in the subject line so your notice is routed correctly.
Registration of our designated agent with the US Copyright Office is in progress. This page will be updated with the agent's name and mailing address once that registration is complete.
Counter-notice
If your content was removed or disabled in response to a DMCA notification and you believe the removal was a mistake or misidentification, you may file a counter-notice under DMCA § 512(g). A valid counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and phone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which you reside (or, if outside the United States, any judicial district in which Wheelhouse may be found) and that you will accept service of process from the person who filed the original notification.
On receipt of a valid counter-notice, we forward a copy to the original complainant. If the complainant does not file a court action seeking a restraining order within ten business days, we may restore the removed material.
Repeat infringers
Wheelhouse may terminate accounts that repeatedly infringe.
